- - The property should not be reserved or mortgaged except with the approval of the mortgaged authority - The property to be transferred is not to be transferred to the usufruct on it any legal contraindications
- Both parties (owner and usufructuary) must be at least 18 years old, capable of making the transaction, or represented by a valid power of attorney. The property should not be under seizure or mortgage without the mortgagee’s consent and must not be affected by planning restrictions. The cadastral plan must be renewed if necessary.
